Lava Hemp USA — Rewards Program Terms & Conditions

Welcome to the Lava Hemp USA Rewards Program (the “Program”). These Terms govern your participation in the Program, including how you earn points, how you redeem them, and the rules that keep the Program fair for everyone. By creating an account on lavahempusa.com, signing in, or earning or redeeming points, you agree to these Terms.

1. About the Program

The Lava Hemp USA Rewards Program lets eligible customers earn points for shopping at lavahempusa.com and for certain other actions. Points can be redeemed for discounts on future purchases. Points are a reward — they are not currency, are not your property, and have no cash value.

The Program is operated by Lava Products USA, located in the United States (“we,” “us,” or “our”).

2. Eligibility

To participate in the Program you must:

• Be a legal resident of the United States;
• Be at least 18 years old (or the age of majority in your state of residence — 21 in some states for the purchase of certain regulated products);
• Be legally permitted under federal and your state and local laws to purchase the products sold on lavahempusa.com;
• Create and maintain a free Lava Hemp USA customer account in good standing; and
• Be a registered retail customer with a Lava Hemp USA account — guest checkouts and unregistered visitors do not earn or redeem points.
• Wholesale, B2B, distributor, and reseller accounts are not eligible to earn or redeem points.
• Comply with these Terms, our general Terms of Service, and our Privacy Policy.

We may decline membership, suspend, or terminate any account at our discretion, including for any violation of these Terms or any conduct we believe is fraudulent, abusive, or harmful to other customers. The Program is void where prohibited by law.

3. Joining the Program

There is no cost to join. You become a member automatically when you create a Lava Hemp USA account or when you sign in for the first time after the Program launches. You can view your points balance and activity at any time in My Account → Rewards or in the floating Rewards widget on lavahempusa.com.

4. How you earn points

Additional ways to earn (such as social follows or custom actions) may be added or removed at our discretion and will appear in the Ways to Earn section of the Rewards widget when active.

When points are credited. Points for purchases are credited once the order is completed (typically when it ships or is fulfilled). They are not credited at the time of order placement. Sign-up, referral, review, birthday, and anniversary points are credited as described above.

Exclusions and limits. Certain products, product categories, customer roles, or specific accounts may be excluded from earning points. Excluded items and accounts do not earn points and are not eligible to redeem. We may change these exclusions at any time without notice. Points are not earned on the value of any discounts, coupons, store credit, gift card purchases, taxes, shipping, or other non-product charges, unless we expressly state otherwise.

5. The value of your points

Points are worth $0.05 each (one hundred points = five dollars off, 100 points = $5.00). This is the only way to use points — points cannot be exchanged for cash, transferred to another account, sold, gifted, combined with another customer’s points, or used outside the Program. Points have no value until they are redeemed for a discount on a qualifying order.

6. How you redeem points

Once you have enough points to meet the minimum redemption amount, you can apply them at the cart, the checkout, or from the Rewards widget. Enter the number of points you wish to apply; the corresponding discount will be deducted from your order total before payment. Any remaining balance is paid by your normal payment method.

• A minimum number of points may be required to redeem at one time. The current minimum is shown in the redeem field at checkout.
• Points must be redeemed in the increments displayed at checkout.
• We may set a maximum share of an order that can be paid with points. The current maximum is enforced automatically.
• Points are deducted from your balance when the order is placed. If the order is later cancelled, refunded, or fails, the points may be returned to your balance as described in Section 8.
• Points cannot be applied to a past order or combined with certain other promotions where prohibited.

7. Referral Program

If you have a Lava Hemp USA account, you have a unique referral link, available in the Refer a Friend section of the Rewards widget.

• The new friend must use your link to sign up, must be a new customer (not someone with an existing or recently closed account at our store or affiliated stores), and must not be you or share an address, payment method, or device with you.
• You are credited the referral points when your referred friend’s first order is completed, not at sign-up.
• We may delay, withhold, or revoke referral credits if we have reason to believe a referral is fraudulent, manipulated, or in violation of these Terms — for example, self-referrals, duplicate accounts, fake email addresses, or referrals coordinated solely to earn points.
• Referral points already credited to a referrer are not clawed back if the referred friend later cancels or refunds the qualifying order.

8. Returns, cancellations, and refunds

If an order on which you earned points is fully or partially cancelled or refunded, the corresponding points will be removed from your balance. If removing those points would leave your balance below zero, your balance will be set to zero. If an order on which you redeemed points is cancelled, refunded, or fails before payment, the redeemed points will be returned to your balance. If a previously cancelled, refunded, or failed order is reinstated (returned to an active or completed status), the corresponding adjustments will be reversed accordingly.

9. Expiration of points

By default, points do not expire. We may introduce an expiration policy in the future (for example, points expiring after a period of account inactivity). If we do, we may update these Terms without prior notice. Points expired under such a policy cannot be reinstated.

10. Changes to or termination of the Program — your rights and ours

You can leave the Program at any time by closing your Lava Hemp USA account or by contacting us at [email protected]. Upon closure, your unredeemed points will be forfeited and cannot be reinstated unless we, in our sole discretion, decide to honor them.

We may change, deactivate, suspend, or terminate the Program at any time, for any reason, and WITHOUT NOTICE to members, including (without limitation):

• Adding, changing, or removing earning actions or their point values;
• Reducing the number of points required or awarded for any action, retroactively or going forward;
• Changing the redemption rate (the dollar value of one point);
• Changing minimums, increments, the maximum share of an order payable with points, or any other redemption rule;
• Restricting eligible products, categories, customer roles, or accounts;
• Suspending the Program temporarily;
• Permanently deactivating, discontinuing, or cancelling the Program; and
• Adjusting, reducing, expiring, or cancelling outstanding points balances — including reducing balances to zero — if the Program is materially changed or discontinued, without any notification to members.

We are not required to give you any advance notice of any change, reduction, deactivation, or termination of the Program or your points balance. Notice, if provided at all, may be given in any manner we choose — including posting an update to these Terms on lavahempusa.com, in your account, or in the Rewards widget — and is effective immediately upon posting. Your continued participation in the Program after any change takes effect constitutes your acceptance of the change.

Points are not your property. You acknowledge that points are a promotional benefit only, are not consideration paid by you, are not a property right, and may be modified, reduced, or cancelled by us at any time without notice as described in these Terms. You will not be entitled to any compensation, in cash or otherwise, if your points are modified, reduced, cancelled, expired, or rendered unusable for any reason.

11. Fraud, abuse, and account suspension

To keep the Program fair, we may withhold, reduce, or revoke points, and may suspend or terminate any account, if we believe in good faith that the account or its activity violates these Terms or involves:

• Fraudulent or chargeback orders;
• Fake, automated, or duplicate accounts;
• Fake, paid-for, or AI-generated reviews;
• Manipulated referrals (including self-referrals, household referrals, or coordinated rings);
• Bots, scripts, or automated tools used against the Program;
• Any attempt to game, exploit, or reverse-engineer the Program;
• Purchases of products by individuals not legally permitted to purchase them; or
• Other activity we reasonably believe is harmful, deceptive, or unlawful.

We may also reverse points credited as a result of technical errors, pricing errors, or honest mistakes.

12. Taxes

Any tax consequences of receiving, redeeming, or otherwise earning value from points are your sole responsibility. We do not provide tax advice. Consult your tax advisor for any questions about how rewards programs may be treated under federal, state, or local tax law.

13. Privacy

We collect and use your account information to operate the Program. Our use of your information is described in our Privacy Policy, which is incorporated into these Terms by reference. If you are a California resident, you have specific rights regarding your personal information described in our Privacy Policy.

14. No warranties

The Program is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to the Program and your points balance.

15. Limitation of liability

To the maximum extent permitted by applicable law, our total liability arising out of or relating to the Program shall not exceed the U.S. dollar value of the points then credited to your account, calculated at our then-current redemption rate. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data, arising out of the Program. Some states do not allow the exclusion or limitation of certain damages; in those states, the foregoing limitations may not apply to you.

16. Governing law and venue

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Program shall be brought exclusively in the state or federal courts located in Jackson County, Oregon, and you consent to the personal jurisdiction of those courts. The federal Arbitration Act, the laws of the United States, and (where applicable) state consumer-protection laws also apply.

17. Entire agreement and severability

These Terms, together with our Terms of Service and Privacy Policy, are the entire agreement between you and us with respect to the Program. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
